Please read these Terms of Service ("Terms") carefully before using SharpShotPicks (the "Service", "we", "us", or "our"). By accessing or using SharpShotPicks — including any website, tool, optimizer, simulation, or content we provide — you ("User", "you") agree to be legally bound by these Terms. If you do not agree to these Terms in their entirety, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and SharpShotPicks. We recommend printing or saving a copy for your records.

1. Acceptance of Terms

By creating an account, accessing the Service, or clicking any "I agree," "Sign Up," or similar button, you represent and warrant that:

  • You are at least 18 years of age;
  • You have the legal capacity and authority to enter into a binding contract;
  • You are not prohibited from using the Service under applicable law;
  • All information you provide to us is accurate, complete, and current; and
  • You have read, understood, and agree to these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Eligibility & Geographic Restrictions

The Service is intended for users located in jurisdictions where daily fantasy sports ("DFS") contests and/or sports wagering are legal and permitted. Daily fantasy sports and sports betting are not legal in all states or countries. It is solely your responsibility to determine whether your participation in DFS contests, sportsbook wagering, or use of any sports analytics tools is lawful in your jurisdiction. SharpShotPicks makes no representation that the Service is appropriate or available for use in all locations. By using the Service, you represent that doing so is legal under the laws applicable to you.

3. Description of Service

SharpShotPicks is a daily fantasy sports analytics platform that provides, among other things:

  • Player statistical projections and performance grades;
  • Probabilistic simulations and statistical modeling;
  • DFS lineup optimization tools for platforms including DraftKings;
  • Slate analysis, stacking recommendations, and ownership projections;
  • Sport-specific tools covering NHL, NBA, NFL, MLB, NASCAR, PGA, EPL, UCL, WNBA, MMA, and other sports as added.

The Service is provided for informational and entertainment purposes only. Nothing on SharpShotPicks constitutes financial, legal, or gambling advice. SharpShotPicks is not affiliated with, endorsed by, or sponsored by DraftKings, FanDuel, or any other DFS operator.

4. No Guarantee of Results

All projections, grades, optimizer outputs, simulation results, recommendations, and any other analytical content provided through SharpShotPicks are statistical estimates derived from historical data, proprietary algorithms, and modeling assumptions that may contain errors or omissions. These outputs are inherently uncertain and subject to change.

SharpShotPicks makes absolutely no guarantee of winning outcomes, profitability, or financial gain of any kind. Use of the Service does not ensure success in any DFS contest, sports bet, wager, or any other real-money competitive activity. Past performance reflected in any projection, model, or historical data is not indicative of future results. You acknowledge and agree that:

  • DFS contests and sports wagering involve significant risk, including the risk of total financial loss;
  • SharpShotPicks' tools are one input among many and should not be relied upon as the sole basis for any DFS decision;
  • Real-world outcomes are affected by factors outside any model's control, including injuries, game-time decisions, weather, and officiating; and
  • You bear full responsibility for all DFS entries and financial decisions made using or influenced by the Service.

5. Age Restriction

You must be at least 18 years of age to register for or use the Service. By accessing SharpShotPicks, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age at any time and to terminate or suspend any account we have reason to believe is held by a user under the age of 18, without notice or refund. If we discover that a user is underage, any associated account will be permanently closed.

6. User Accounts

To access certain features of the Service, you must register for an account. When creating an account, you agree to:

  • Provide accurate, complete, and current registration information;
  • Maintain the security and confidentiality of your password;
  • Notify us immediately of any unauthorized access to your account; and
  • Accept responsibility for all activity that occurs under your account, whether or not authorized by you.

You may not create more than one account, share your account credentials with any other person, or transfer your account to another person. SharpShotPicks reserves the right to refuse registration, cancel accounts, or remove or edit content at our sole discretion.

7. Subscriptions & Payments

SharpShotPicks offers paid membership plans that unlock premium features, tools, and content. Details regarding available subscription tiers, features included, and current pricing are available on our Memberships page. By purchasing a subscription or any other paid product, you agree to the following:

  • Authorization: You authorize SharpShotPicks and/or its payment processor(s) to charge your designated payment method for the applicable fees at the time of purchase and at each renewal interval.
  • Recurring Billing: Subscriptions automatically renew at the end of each billing cycle (monthly or annual, as applicable) unless you cancel prior to the renewal date.
  • Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service through the end of the current paid billing period. No partial-period credits will be issued.
  • Price Changes: We reserve the right to change our pricing at any time. If we change the price of your subscription, we will provide notice and your continued use of the Service after the price change takes effect constitutes your agreement to the new price.
  • Failed Payments: If your payment fails, we may suspend or terminate your access to premium features until payment is received.

8. No Refund Policy

All purchases made through SharpShotPicks — including subscriptions, one-time purchases, and any other paid products or features — are final and non-refundable. Once a transaction is processed, no refunds, credits, or exchanges will be issued for any reason, including but not limited to:

  • Dissatisfaction with the Service or its outputs;
  • Failure to cancel before a renewal date;
  • Partial use of a subscription period;
  • Account termination due to a violation of these Terms;
  • Technical issues on the user's end (e.g., device, browser, internet connection); or
  • DFS losses, poor contest performance, sportsbook losses, or any other real-money wagering losses.

By completing a purchase, you expressly acknowledge and accept this no-refund policy. To the extent permitted by applicable law, you waive any right to a chargeback except in cases of unauthorized transactions. If you believe a charge was made in error, contact us promptly before initiating a chargeback with your financial institution.

9. Intellectual Property

All content, materials, features, and functionality available through the Service — including but not limited to text, graphics, logos, icons, images, data models, algorithms, simulation engines, optimizer code, lineup tools, projections, rankings, software, and the overall design and compilation of the Service — are the exclusive property of SharpShotPicks or its licensors and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial DFS purposes subject to these Terms. You may not:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service;
  • Distribute, publish, or publicly display any content from the Service without written authorization;
  • Modify, create derivative works from, or reverse-engineer any part of the Service;
  • Remove any copyright, trademark, or other proprietary notices from the Service; or
  • Use any content from the Service for commercial purposes or on behalf of any third party.

Any unauthorized use of SharpShotPicks' intellectual property may result in immediate account termination and may subject you to civil and/or criminal liability.

10. Prohibited Conduct

You agree that you will not, under any circumstances:

  • Use the Service for any purpose that is unlawful, fraudulent, or prohibited by these Terms;
  • Share, sell, lease, sublicense, or otherwise transfer access to your account or any content obtained through the Service to any third party;
  • Use automated tools, bots, scrapers, crawlers, or similar technologies to access, collect data from, or interact with the Service without prior written consent from SharpShotPicks;
  • Attempt to probe, scan, or test the vulnerability of the Service or any related system or network, or breach any security or authentication measures;
  • Interfere with or disrupt the integrity, performance, or availability of the Service or its underlying infrastructure;
  • Upload, transmit, or distribute any malicious code, virus, or harmful content through the Service;
  • Misrepresent your identity or affiliation with any person or organization;
  • Harass, harm, or discriminate against any user or SharpShotPicks personnel; or
  • Violate any applicable local, state, national, or international law or regulation.

SharpShotPicks reserves the right to investigate suspected violations and, at our sole discretion, immediately terminate access for any user found in violation without notice or refund.

11. Third-Party Services & Links

The Service may integrate with, reference, or provide links to third-party services, platforms, and websites — including but not limited to DraftKings, FanDuel, payment processors, data providers, and odds APIs. These third-party services are governed by their own terms of service and privacy policies, which we encourage you to review.

SharpShotPicks has no control over and assumes no responsibility for the content, accuracy, privacy practices, or availability of any third-party services. The inclusion of any third-party link or integration does not imply our endorsement or affiliation. Your use of third-party services is entirely at your own risk.

12. Privacy & Electronic Communications

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and share information about you when you use the Service. By using SharpShotPicks, you consent to the collection and use of your information as described in our Privacy Policy.

By creating an account, you consent to receive electronic communications from us, including account-related notices, promotional emails, and Service updates. You may opt out of marketing communications at any time, but you cannot opt out of transactional or account-related communications while your account remains active.

13. Account Suspension & Termination

SharpShotPicks reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate your account and membership at any time, with or without notice, including but not limited to:

  • Violation of these Terms or any applicable law;
  • Fraudulent, abusive, or harmful behavior;
  • Chargebacks or payment disputes initiated without authorization;
  • Sharing or reselling account access;
  • Conduct that may harm SharpShotPicks, other users, or any third party; or
  • Any other reason at our sole and absolute discretion.

Upon termination, your right to use the Service immediately ceases. No refunds will be issued for any remaining subscription period, regardless of the reason for termination. If you believe your account was terminated in error, please contact us to appeal. We are not liable to you or any third party for any suspension, restriction, or termination of your access to the Service.

You may also terminate your account at any time by contacting us or using the account settings. Termination does not relieve you of any obligations incurred prior to termination.

14. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SharpShotPicks does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free;
  • Any projection, grade, simulation result, or other output will be accurate, complete, or reliable;
  • Any defects in the Service will be corrected; or
  • The Service or its servers are free of viruses or other harmful components.

You assume all risk associated with your use of the Service and any reliance on its outputs.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHARPSHOTPICKS AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO:

  • Your use of or inability to use the Service;
  • Any reliance on projections, optimizer outputs, or analytical content;
  • Financial losses incurred in DFS contests, sportsbook wagers, sports bets, or any other real-money wagering activity informed or influenced by the Service;
  • Unauthorized access to or alteration of your account or data;
  • Conduct of any third party in connection with the Service; or
  • Any other matter relating to the Service.

In no event shall SharpShotPicks' total aggregate liability to you for all claims arising out of or related to these Terms or the Service exceed the greater of (a) the total amount you paid us in the ninety (90) days immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless SharpShotPicks and its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of or access to the Service;
  • Your violation of these Terms;
  • Your violation of any applicable law or regulation;
  • Your violation of any rights of any third party; or
  • Any content you submit, post, or transmit through the Service.

SharpShotPicks reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

17. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and SharpShotPicks agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except as set forth below.

Informal Resolution First: Before initiating arbitration, you agree to contact us at the address provided below and attempt to resolve the Dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any Dispute shall be resolved by binding arbitration administered in accordance with the rules of a recognized arbitration body, conducted in the Commonwealth of Pennsylvania or via telephone/video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AND SHARPSHOTPICKS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. If this waiver is found unenforceable, the entire arbitration agreement shall be null and void.

Exceptions: Either party may seek emergency equitable relief in a court of competent jurisdiction to prevent imminent harm, including unauthorized use of intellectual property.

18. Governing Law & Jurisdiction

These Terms and any Disputes arising hereunder shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. To the extent any claim is not subject to arbitration, you consent to the exclusive personal jurisdiction of the state and federal courts located in Pennsylvania, and you waive any objection to venue in such courts.

19. DMCA & Copyright Infringement

SharpShotPicks respects the intellectual property rights of others and expects users to do the same. If you believe that any content on the Service infringes your copyright, please contact us with the following information:

  • A description of the copyrighted work you claim has been infringed;
  • The URL or location on the Service where the infringing content is located;
  • Your contact information (name, address, phone, email);
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner; and
  • A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf.

We will respond to valid DMCA notices and, where appropriate, remove or disable access to infringing content and terminate accounts of repeat infringers.

20. Force Majeure

SharpShotPicks shall not be liable for any failure or delay in performance of our obligations under these Terms arising from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government actions, internet or telecommunications failures, power outages, denial-of-service attacks, third-party service failures, or any other event outside our reasonable control (each, a "Force Majeure Event"). During a Force Majeure Event, our obligations under these Terms will be suspended for the duration of the event. We will make commercially reasonable efforts to resume normal operation as soon as practicable.

21. Modifications to the Service

SharpShotPicks reserves the right to modify, suspend, or discontinue the Service — or any feature or portion thereof — at any time, with or without notice, for any reason. This includes changes to available sports, tools, optimizer functionality, simulation models, or any other feature. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

22. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you via email or a prominent notice on the Service. Your continued use of the Service after changes are posted constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.

23. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions of these Terms shall continue in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and SharpShotPicks with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Service. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of SharpShotPicks. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
